Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and John Paul Kobrossi, doing business as JobTally ("JobTally," "we," "us," or "our") governing your use of the JobTally web application and websites at getjobtally.com and jobtallyapp.com (the "Service"). Please read them carefully.

Plain-language summary (not a substitute for the Terms): JobTally is a job-costing and time-tracking tool for contractors. You keep ownership of your data. Paid plans auto-renew until you cancel. JobTally is just software — you remain the employer of your workers and are responsible for wage, overtime, and location-notice laws. The Service is provided "as is," and our liability is limited. 1. Acceptance of these Terms

By creating an account, accepting an invitation, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other organization, you represent that you are authorized to bind that entity, and "you" refers to that entity.

2. Description of the Service

JobTally is a mobile-first web application that helps small contractors track jobs and projects, record worker time (including GPS location captured at clock-in and clock-out), manage clients, capture receipt and jobsite photos, scan receipts using AI to extract store name and amount, track mileage and labor costs, and create estimates and invoices. Features may change, improve, or be discontinued over time. We may set reasonable limits on usage, storage, or features, and may offer different features on different subscription plans.

Paid subscriptions

Business owners subscribe to a paid plan to use JobTally. Subscription fees, billing cycles (monthly or yearly), and features are described at checkout. All fees are stated in U.S. dollars unless noted and are exclusive of any applicable taxes, which you are responsible for.

Auto-renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current rate, and your payment method is charged automatically, until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.

Payment processing

Payments are processed by Stripe. JobTally does not store your full card details. Your use of Stripe is subject to Stripe's terms and privacy policy.

Cancellation

You may cancel at any time through the billing portal in your account. Cancellation stops future renewals; it takes effect at the end of your current paid period, and you retain access until then.

Refunds

Except where required by applicable law, fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or downgrades. If we materially change or discontinue a paid feature, we will act reasonably and in accordance with law.

Price changes

We may change subscription prices. We will give you advance notice (for example, by email or in-app) before a price change takes effect, and the new price will apply to your next renewal. If you don't agree, you may cancel before the change takes effect.

Failed payments

If a charge fails, we may retry and may suspend or downgrade your access until payment succeeds. You remain responsible for amounts owed.

6. Your content & data ownership

You own your data. As between you and JobTally, the business owner (customer) retains all rights to the data, photos, job information, client information, and other content submitted to the Service ("Customer Content"). We do not claim ownership of it.

To operate the Service, you grant JobTally a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, process, and otherwise use Customer Content solely as needed to provide, secure, maintain, and improve the Service and to perform our obligations under these Terms (for example, storing photos, sending AI receipt images to our AI provider for extraction, and delivering notification emails). This license ends when the relevant Customer Content is deleted, except for residual copies in backups purged in the ordinary course and for content we must retain by law.

You are responsible for the accuracy, quality, and legality of Customer Content and for having the necessary rights and consents (including from your workers and clients) to submit it to the Service. We may use aggregated and de-identified data that does not identify you or any individual to operate and improve the Service.

7. Owner–worker relationship & your compliance duties

JobTally provides software only. JobTally is not the employer of your workers, is not a party to the employment relationship between a business owner and their workers, and does not provide legal, tax, accounting, payroll, or employment advice.

If you are a business owner, you are solely responsible for complying with all laws that apply to your business and your workers.

As a business owner, you are solely responsible, without limitation, for:

You agree that JobTally has no responsibility or liability for your employment, wage, tax, or notice obligations, and you will indemnify us for claims arising from them as described in Section 11.

8. Third-party services

The Service relies on third-party providers, including Supabase, Vercel, Stripe, Anthropic (Claude API), Resend, and Cloudflare. Your use of the Service may also be subject to those providers' terms. We are not responsible for third-party services, and their availability or performance may affect the Service. Links or integrations to third-party products are provided for convenience and do not imply our endorsement.

9. Disclaimers

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data, calculation, or AI-generated result will be accurate or complete. In particular, time totals, labor costs, mileage, estimates, invoices, profit calculations, and AI-extracted receipt data (such as store name and amount) are provided for convenience only and are not guaranteed to be accurate for tax, legal, payroll, accounting, or any other purpose. You are responsible for reviewing and verifying all figures before relying on them. You use the Service at your own risk.

10. Limitation of liability

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless JobTally and its owners, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your Customer Content; (c) your violation of these Terms or any law; (d) your relationship with your workers, including any wage-and-hour, overtime, classification, privacy, or location-tracking notice/consent claim; and (e) your handling of client or customer information. We may assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate with us.

12. Termination

You may stop using the Service at any time, cancel your subscription through the billing portal, and (for owners) delete your account from within the app. We may suspend or terminate your access if you breach these Terms, fail to pay, use the Service unlawfully, or if we reasonably need to protect the Service or other users. We may also discontinue the Service with reasonable notice.

On termination, your right to use the Service ends. For a reasonable period after termination, an owner may request an export of their data; after that, we may delete Customer Content in accordance with our Privacy Policy, except where retention is legally required. Sections that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, 13, and 15) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to arbitration or small-claims court will be the state or federal courts located in Rensselaer County, New York, and you consent to their personal jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any claim must be brought within one (1) year after it arises, to the extent permitted by law.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice (such as an in-app notice or email). Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and, if applicable, cancel your subscription.
